This article continues a series that will review various state-level compliance topics in alphabetical order to provide reminders on compliance requirements and relevant resources.  The topics are being pulled from the CADA Colorado Dealer Compliance Guide.

Topic #8: Consumer Credit Code – Annual Filing


Colorado is one of eleven states that have adopted the Uniform Consumer Credit Code ("UCCC").  The UCCC regulates consumer credit transactions and is generally enforced by the Administrator of the Uniform Consumer Credit Code within the Colorado Attorney General's Office.  A "consumer credit sale" is where a person who regularly engages in the sale of products used for personal, family, or household purposes makes or arranges the financing for the sale of such goods.  The UCCC requires that all consumer credit transactions be made by written agreement, and applies to any consumer credit sale of goods of $75,000 or less. 

Auditors from the UCCC office do regularly audit dealerships.  A key requirement is the annual notice filing that applies to most all dealerships.  The fee/process is simple, but if not done, the penalties can add up quickly:

Annual Notice Filing
Dealerships, as retail merchants that regularly extend consumer credit and "arrange financing" (even if all paper is ultimately assigned to a lender) are included in the UCCC requirement to annually file with the state.   The annual notice fee is $150.00 as of January 2015.  The fee can change each year, so check the attorney general’s web site or contact CADA.  www.coloradoattorneygeneral.gov/uccc

The filing is due by January 31st each year (there is a 30-day grace period; late fees of $5.00 per calendar day apply starting on March 1st each year).

Other key compliance requirements covered by the UCCC include:

  • Any charge related to financing must be included in the APR calculation (i.e., dealer-level fees related to any aspect of arranging credit can be problematic). 
  • Various disclosures regarding GAP must be provided to consumers, and a separate, written cancellation form must be provided (GAP companies typically provide, but sometimes have been overlooked by dealership staff).  Proof should be retained that the customer received the cancellation form.  A specific rule (Rule 8) covers GAP overall.
