There has been a significant increase in litigation against employers for alleged violations of the Fair Credit Reporting Act (FCRA), including a number of class action lawsuits. Now there are suits alleging employers did not provide pre-adverse action notice, or failed to wait a “reasonable” amount of time before taking adverse action by making a final decision not to hire someone.

The FCRA lays out specific requirements regarding adverse action and background screens. An employer uses a background screening service to run a background screen on an individual they would like to hire, but the background screen comes back with criminal records. What does the employer do?

REMINDER: UNIFORM CONSUMER CREDIT CODE (UCCC) - ANNUAL FILING * * *DUE JANUARY 31ST * * * 



Most all dealers in Colorado need to make this annual filing with the Attorney General’s office.  The few exceptions include dealerships that do not assign any retail paper (installment contracts), do not arrange financing, or do not make any consumer credit transactions (but focus solely on commercial). 

The annual notice fee for 2016 is $130.00
 (this fee actually decreased by $20.00 from last year). 
LATE FEES: the annual fee is due each year by January 31st, with a one-month grace period; late fees of $5.00 per day start to accrue (from Feb. 1st) if payment is not received by March 1st).

Clarification  CQuestion #6:  DO YOU COLLECT PAYMENTS ON THE CONTRACTS YOU ORIGINATE? (CIRCLE ONE) YES OR NO. 
The UCCC office is attempting to capture information regarding pure in-house “buy here pay here” financing.  Dealers should answer this question “no” even though they might accept the first payment in a lease agreement.

The Attorney General Office is moving to a new web site, which has the latest information, the new UCCC site is: www.coag.gov/uccc

About the UCCC: The Colorado Uniform Consumer Credit Code (UCCC) is a state law that regulates the terms and conditions of consumer credit in the State of Colorado. It sets maximum rates and charges for some fees, requires disclosure of the cost of credit so consumers may shop for the best rates, and provides remedies for consumers on default.  Dealerships, as retail merchants that regularly extend consumer credit and "arrange financing" (even if all paper is ultimately assigned to a lender) are included in the UCCC requirement to annually file with the state. The UCCC is enforced by an Administrator within the Attorney General’s office

Experts have found that real life examples of how individuals have behaved in the past are a better predictor of the future than hypothetical situations. But how do you effectively conduct behavioral interviewing? Conducted correctly you can end an interview with an excellent predictor of the future and a good potential employee. However, poorly conducted behavioral interviews could lead to poor hiring and getting stuck with an employee that is a bad fit for the company.
