REIN IN THE RECALL REVOLUTION

Automotive recalls present an opportunity to maintain and improve dealer and brand integrity, while winning back lost customers and attracting new customers that do not typically service at a factory-certified dealer. Historically, however, recalled vehicle owners have been viewed as a nuisance by dealership personnel, at times frustrated and emotionally volatile. They are viewed as demanding and unwilling to spend money on additional CP repairs identified through a MPI. And, finally, as a source of negative CSI, even in scenarios where they were treated well by the dealership.  It’s no wonder that many dealers avoid these customers altogether. Having held almost every position in the dealership, Danny brings a wealth of knowledge as well as humorous perspective. Here is how your participation works. You are invited to provide well-informed dealership representatives to drive performance, classic and “green” vehicles to scheduled events in your community. The cars will be displayed with others at the designated location. We will produce signage for each vehicle with the name of your dealership, the make and model of the vehicle and, with respect to “green” cars how it is environmentally friendly (hybrid, plug-in hybrid, fully electric, E-85, clean diesel, high efficiency). Your dealership representative will need to be onsite and available to answer questions.

UNITED STATES SUPREME COURT REJECTS ALLIANCE'S ATTACK ON MOTOR VEHICLE FRANCHISE LAWS

On March 7, 2016, the United States Supreme Court ended the Alliance of Automobile Manufacturer's multi-year effort to undo Connecticut's warranty reimbursement provisions when it rejected the Alliance's last-ditch appeal to have the Connecticut law declared unconstitutional.  The Supreme Court's rejection of the Alliance's appeal brings to an end the Alliance's three-plus year quest to attack the State's franchise laws.  The Supreme Court's decision also affirms the Second Circuit Court of Appeals' rejection of the Alliance's Constitutional claims as well as the District Court of Connecticut's rejection of those claims.  In all, the Alliance's Constitutional claims were rejected a total of five consecutive times during the course of this litigation.

Richard Sox and Jason Allen of Bass Sox Mercer represented the Connecticut Automobile Retailer's Association at every step in this litigation, and argued the case before the District and Appellate Courts.

The Supreme Court's decision is a huge victory for not only Connecticut franchised automobile dealers but dealers around the United States as well.  The Alliance's attack, if successful, would have not only applied to the Connecticut franchise laws, but could have been used to attack motor vehicle franchise laws in every state.
