12TH ANNUALCADA MEMBER GOLF EVENT

Due to unfortunate weather at and around the United States Air Force Academy Monday, golf course staff and event organizers were forced to cancel the 12th Annual CADA Member Golf Event. While we had hoped that the storm would pass quickly, it ultimately persisted well into the afternoon forcing cancellation. Fortunately, all golfers remained in good spirits, enjoying golf lessons from the club pro, a putting contest and time on the range before the weather interfered. Afterwards, everyone moved to the reception site to wait out the weather, where they enjoyed an ice cream station while staff awarded a series of amazing door prizes. All in all, while the weather could have been much better, the mood was excellent.

We thank our sponsors, including Title Sponsor, EKS&H, awards reception sponsor, DealerTrack, boxed lunch sponsor, Federated Insurance, and all of our wonderful partners who took time to support the organization and its members. For those of you who left early, the USAFA generously offered vouchers for a free round of golf to each registered golfer. If you did leave early and did not receive your voucher, please contact Khorrie Luther at khorrie.luther@colorado.auto. We look forward to seeing you next year at the 13th Annual CADA Member Golf Event (course and date to be determined).

a
AUTO INDUSTRY NEWS AT A GLANCE

Listed here are several articles pertaining to the auto industry in general that appeared recently in newspapers and other media outlets across the nation.

…more news articles are included at the end of this issue.

A TO Z COMPLIANCE: [C]onsumer Protection Act

This article continues a series that reviews various state-level compliance requirements in alphabetical order to provide reminders on compliance requirements and relevant resources.  The requirements highlighted are being pulled from the 2016 CADA Colorado Dealer Compliance Guide

Topic #9: Consumer Protection Act – Security Breach Notification

A relatively new provision of the Colorado Consumer Protection Act (CCPA) that could impact dealers is a security breach notice requirement. Dealerships need to ensure proper handling of a computer system breach that might compromise customer personal information. Colorado requires that businesses conduct a “prompt investigation” to determine the likelihood that personal information has been or will be misused. If the internal investigation determines personal information has been compromised and is reasonably likely to occur, notice must be provided. Notice should be provided expediently and without unreasonable delay.

Depending on the scope of the breach, other consumer reporting agencies may also need to be informed.

Dealers should be aware of this state requirement and if a security breach occurs consult the specific provisions in C.R.S. 6-1-716.  Note that the CCPA provides for triple damages and attorneys’ fees

FEDERATED INSURANCE: AUTO DEALER CLAIM OF THE MONTH

Federated Insurance’s “Claim of the Month” – Could it happen to you?

A salesperson began the test drive behind the wheel, with the customer in the passenger’s seat. Wanting to demonstrate some of the vehicle’s abilities, the driver ran through a series of sudden accelerations and stops, and fast, sharp turns. As a result of the salesperson’s reckless driving, the customer suffered a herniation in his neck.
CLAIM AMOUNT: $1.25 million

What policies are in place to help prevent this from happening at your dealership? Do you know who’s driving your vehicles? Federated Insurance recommends several best practices to help protect your business and manage risks; for example,

  • Ensure that dealership employees understand what is and isn’t acceptable during a test drive.
  • Use pre-established test drive routes.
  • Mandate seatbelt usage.

These are just a few loss control recommendations you can use to help protect your dealership. To learn more, contact your local Federated Insurance representative and request a copy of our Auto Dealer “Keys to Success” risk management packet. Federated Insurance is recommended by 19 state and national auto dealer associations just like yours for customized insurance programs and value-added risk management services, such as Federated’s Shield Network®, the Risk Management Resource Center, and the Federated Employment Practices Network®. To discover how Federated can help you create or ramp up your own risk management program, contact your local representative.
