IMPORTANT CLAIM FILING DEADLINE THIS WEEK FOR VW EMISSIONS SETTLEMENT - DEALERS ELIGIBLE

Non-VW/Audi dealers have a short deadline to identify themselves in order to be eligible for benefits under the VW Emissions settlement with the FTC.  This settlement covers 2.0-liter TDI vehicles; negotiations are continuing regarding 3.0-liter vehicles:

The September 16, 2016 deadline applies to certain “Eligible Sellers”, which are those meeting both of the following conditions:

(1)   purchased or acquired an eligible vehicle on or before September 18, 2015; AND
(2)   sold or transferred ownership of the vehicle after September 18, 2015 but before June 28, 2016. 

Eligible sellers also include dealers (but EXCLUDE VW or Audi dealers) who previously purchased or acquired an eligible vehicle within this timeframe.  There are some complexities regarding dealerships that have VW/Audi along with other lines—eligibility may depend upon how corporate entities are structured.  However, to preserve eligibility, a filing must be made by September 16th.

An Eligible seller must file by September 16, 2016 (by registering online at www.VWCourtSettlement.com or submitting the Eligible Seller Identification Form by mail or fax) to receive any benefits.

  • According to the claim form, those who qualify as Eligible Sellers “will be entitled to at least $2,550.” 

NOTE:  this earlier deadline does not apply to other types of claimants, such as current owners and lessees of vehicles.  It also does not apply to VW and Audi brand dealers.

DEALERS MAY NOW ISSUE SECOND SIXTY-DAY TEMPORARY REGISTRATION PERMIT

Dealerships should all have been notified through the QuickTags temporary permit system that a second temporary permit can now be issued.  Previously, the system disallowed the issuance of a second temporary permit for the same vehicle based on prior law.  Legislation (SB16-140) that CADA helped to pass became effective August 10, 2016.  This legislation provides an affirmative defense when a dealer has failed to deliver title within thirty-days as required by state law and the delay(s) are due to the reasons beyond the dealer’s control.  The bill also provides for dealers to issue a second sixty-day temporary permit in these circumstances.  The dealer must have taken every “reasonable action necessary” to facilitate the delivery of title including at a minimum:

  1. processed and mailed any required loan payoffs in a reasonable amount of time;
  2. contacted the prior lender and taken any actions necessary to obtain a certificate of title or duplicate certificate of title, either of which must be free of liens;
  3. taken any action necessary to obtain information or signatures from the prior owner necessary to have a new certificate of title issued for the motor vehicle;
  4. submitted all paperwork that the dealer has obtained to the authorized agent and that is necessary to have a new certificate of title issued for the motor vehicle; and
  5. corrected any errors in any filings with the department in a reasonable amount of time.

A salesperson began the test drive behind the wheel, with the customer in the passenger’s seat. Wanting to demonstrate some of the vehicle’s abilities, the driver ran through a series of sudden accelerations and stops, and fast, sharp turns. As a result of the salesperson’s reckless driving, the customer suffered a herniation in his neck.
