At the most recent Motor Vehicle Dealer Board meeting, the Auto Industry Division (the “Division”) advised of difficulty in access to dealership records that staff have recently experienced.   While investigating a complaint, they visited a dealership seeking a specific document from a single deal jacket file.   After showing up at one store that is part of a dealership group, they were advised that all records are stored at a different, centralized location. 

Upon being informed of this after-the-fact (see below), Division staff went to the central location.  At that store, the investigator was informed that they would need to obtain approval from their corporate counsel and that the Division would need to complete a request form.  After delay in reaching this person to obtain approval, the dealership attorney confirmed that Colorado law does gives this access to investigators and instructed the dealership to do so.  The Division specifically asked the trade associations to remind members of the following in Colorado laws and regulations:

  1. If dealership records are being stored anywhere other than the physical store, dealerships should advise the Division of that so they know where to readily obtain.  A simple request letter on dealer letterhead is sufficient.  Click here for a sample.  This is required under the following statutory definition:

    12-6-102. Definitions. … (16) "Principal place of business" means a site or location devoted exclusively to the business for which the motor vehicle dealer or used motor vehicle dealer is licensed and businesses incidental thereto. . . ; except that a dealer may keep its books and records at an off-site location in Colorado after notifying the board in writing of such location at least thirty days in advance.

  2. The regulation adopted under this statute also states that Division staff are entitled to the “inspection” of records as follows: 

    REGULATION 12-6-102(16) . . .  3. The books and records of each dealer, excluding financial statements and tax returns, shall be open to inspection Monday through Friday between 9AM and 5PM by the Board and its agents and representatives with cause, including ongoing investigation, compliance audit, sworn complaint, order of the Board. All records, including financial records and tax returns shall be provided upon subpoena by the Board.

Note that the dealership is entitled to demand a subpoena if records are being requested to be “provided” and not just for inspection on-site.  The Division director routinely issues such subpoenas.

Federated Insurance’s “Claim of the Month” – Could it happen to you?

A dealership’s part-time employee was rushing to complete a dealer trade and arrive at his destination prior to closing time. On his way, he slammed into another vehicle. The crash caused two deaths and two serious injuries. The police determined that the employee was driving 20 miles per hour over the speed limit, talking on his cell phone, and never even applied the brakes.
CLAIM AMOUNT: $4.5 million
