NEW I-9 FORM RELEASED: REQUIRED AS OF FEBRUARY 2
Last week, the United States Citizenship and Immigration Services (USCIS) released the newest edition of the Employment Eligibility Verification Form I-9. The new form is required for all new hires beginning February 2, 2009. [Please note, the new form may only be used beginning February 2. Prior to that date, employers should use the I-9 form with a 06/05/2007 revision date.]
No previous editions of the form will be accepted after February 2.
The new I-9 form is available on the USCIS website. The USCIS has also announced a new edition of its popular Handbook for Employers. Once issued, the new Handbook for Employers will also be available on the USCIS website.
Employers will notice some major changes to the employment eligibility verification process. Most significantly, after February 2 all documentation offered for I-9 purposes must be unexpired at the time it is presented. This marks a complete change from existing I-9 procedures.

AUTO INDUSTRY DIVISION SALESPERSON LICENSE APPLICATION FORM ALERT:
1/23/09 - Effective immediately
AID will no longer accept any DR 2115 forms (Salesperson License Application) that are dated 2006 or earlier.
In 2007, two form versions were created and dated as follows:
5/15/07 - This version will continue to be accepted by AID.
8/3/07 - This is the latest version on file and will be accepted by AID

FORM 8300 CASH REPORTING - CONSUMER NOTICE REMINDER BY JAN. 31
Generally, any person in a trade or business who receives more than $10,000 in cash in a single transaction or related transactions must complete a Form 8300, Report of Cash Payments Over $10,000 Received in a Trade or Business.
Additionally, businesses must notify customers that it has filed a Form 8300 regarding their cash transaction(s) -- in writing, by Jan.31 of the subsequent calendar year.

In January of 2009, the federal government saddled employers with new laws, regulations and obligations under the Americans with Disabilities Act (ADA) and Family Medical Leave Act (FMLA). Workplace law experts expect these new laws will generate an increase in lawsuits against employers—especially in the current economic downturn as downsizing is occurring.
- The U.S. Dept. of Labor announced new FMLA regulations in November, 2008, the first significant changes to the regulations since 1995. Changes effective January 16, 2009 – key changes include:
- Implements two new forms of military family leave created earlier this year
- Expands employer's notice requirements to include a general notice about the FMLA; an eligibility notice; a rights and responsibilities notice; and a designation notice.
- Defines serious health condition
- Changes to medical certification process, fitness for duty evaluations, substitution of paid leave
- The ADA Amendments Act require almost all human resource professionals, managers, and business owners to adopt new policies and procedures in dealing with accommodation requests, as well as greatly impact employment litigation claims.
- Overview of what has changed and how to comply; what is “disabled”?
- What this means to employers and who will be affected
- The risks and penalties of non-compliance; effective date, Jan. 1, 2009.
