DENVER INTERNATIONAL AUTO SHOW GOES GREEN

On behalf of 120 new car dealers in the Denver metro area, welcome to the newly designed 2008 Denver International Auto Show. There are many new exciting additions to the Auto Show this year. 

The public is moving towards the green movement and yet many are unaware of the current offerings of clean green cars available in showrooms today. This year's show will provide an opportunity for everyone to become better acquainted with new clean cars. The line-up of vehicles on display looks very intriguing as we go beyond where any car has ever gone before. We'll see hybrids, flex fuels and the sulfur-free, clean diesel hitting the markets in the way of newly designed and efficient "green" models. 

Several green events have already taken place, including:

 

Congressman Ed Perlmutter checks out a new clean green car for his daughter at Sunday's Green Car Parade at the state capitol.

 

The Green Car Summit panel delivered a energetic and lively discussion on consumer choice, available green technology and fuel efficiency standards. The panel consisted of Keith Hay from Environment Colorado, Laura Dooley of the Auto Alliance and Keith Price from Volkswagen. Tim Jackson of CADA moderated the discussion.

SUNDAY LIQUOR SALES BILL ON RITTER'S DESK
The Denver Post,  March 21

Coloradans soon will be able to pick up a bottle of chardonnay after church if Gov. Bill Ritter signs a bill allowing Sunday liquor sales.

The Senate on Thursday passed Senate Bill 82 on a 25-9 vote, sending it to Ritter's desk. The House passed the legislation earlier in the week.

USE A STATE-CERTIFIED TAX DATABASE FOR SALES TAX INFORMATION
AND RETAIN PROOF

CADA continues to learn that many dealerships are not utilizing either of the state certified, third-party tax jurisdiction providers. It is very important that title processing personnel are looking up tax information in one of these databases to limit liability years later when dealerships may be audited by a city, county or the state. Liabilities can extend to the actual tax that was not collected, interest and penalties that can add up to thirty percent. Taxing jurisdictions are becoming increasingly active in conducting audits of auto dealerships

C.R.S. 39-26-105.3 is the state hold-harmless statute—it provides the following “hold harmless” provision that extends to state-collected and local jurisdiction taxes (including "special districts" such as the Regional Transportation District, Scientific and Cultural Facilities District, Metropolitan Football Stadium District, Republication River Water Conservation District, rural transportation authority districts, local marketing districts, mass transit districts, multi-jurisdictional housing authority districts, regional library districts, and local improvement districts).

(2) Any vendor that uses the data contained in an electronic database certified by the department of revenue pursuant to subsection (3) of this section to determine the jurisdictions to which tax is owed shall be held harmless for any tax, charge, or fee liability to any taxing jurisdiction that otherwise would be due solely as a result of an error or omission in the database.

It is critical that a print-out be made and retained of the information that was relied upon for proof in a later audit. As an example, the Denver city ordinance contains the following specific requirement:

(b)  Any retailer that uses the data contained in an electronic database certified by the state department of revenue pursuant to § 39-26-105.3, C.R.S., to determine the jurisdictions to which tax is owed shall be held harmless for any tax, penalty, or interest owed the city that otherwise would be due solely as a result of an error in the electronic database, provided that the retailer demonstrate that it used the most current information available in such electronic database on the date that the sale occurred. Each retailer shall keep and preserve such records …. (Sec. 53-27.1. Remittance of tax; electronic database; retailer held harmless.)

While home-rule cities and counties are not covered under the state statute; more are adopting this hold harmless provision. Until recently, Denver was the only home-rule that had adopted a local version. Below is a list of participating home-rule cities and counties that have enacted ordinances that hold retailers and other taxpayers harmless if they rely on these certified databases:

Arvada
Aurora
Boulder
Brighton
Denver
Longmont
Northglenn
Silverthorne
Westminster
Wheat Ridge
Woodland Park

INTERNET ADVERTISED PRICE MUST MATCH PRINT ADS

A reminder “advertisement” is defined very broadly under Colorado law—and includes internet postings, listings or targeted advertisements:

C.R.S. (Colorado Revised Statutes) 12-6-102(1.5). Means any commercial message in any newspaper, magazine, leaflet, flyer, or catalog, on radio, televisions or public address system, in direct mail literature or other printed material, on any interior or exterior sign or display, in any window display, on a computer display, or in any point-of-transaction literature or price tag that is delivered or made available to a customer or prospective customer in any manner whatsoever: except that such term does not include materials required to be displayed by federal or state law.

This statute in conjunction with Rule 3 (below) means that internet postings/ads for a specific car cannot contain different prices than those for the same car in other print ads.  The Auto Industry Division has indicated in prior training classes, however, that a coupon that is simply offered via the Internet only would not be in violation of this provision:

Rule 3. Advertising a specific motor vehicle for sale or lease with price or terms quoted, without fully identifying the vehicle as to year, make, model and dealer stock number. Such vehicle shall be willfully shown and sold at the advertised price and/or terms while such vehicle remains unsold or unleased, for a period of five days following the last date the ad was published, unless the ad states that the advertised price and terms are good only for a specific time and such time has elapsed. If a specific number of motor vehicles is advertised, such vehicles must have been invoiced to the dealer.

REVISED MEMO ISSUED REGARDING VEHICLES DONATED
TO A COLLEGE/UNIVERSITY

After some confusion around an earlier memo (dated Sept. 5, 2007), the Titles and Registration Section has issued a revised memo to further clarify the relevant procedures and requirements when dealerships donate cars to public universities.  The purpose of the original memo was to clarify for all counties and dealerships that these ‘donations’ are considered taxable to the dealerships (even though the public institution may be exempt from taxes).

REMINDER: SUNDAY SALES ARE PROHIBITED AT
THE DENVER INTERNATIONAL AUTO SHOW

This is to remind all member dealers who intend to participate in the Denver International Auto Show this year that your sales representatives cannot sell or offer to sell vehicles on Sunday. CADA has always advised sales representatives to refrain from discussing any specifics regarding price, terms, financing, or aspects of an actual sale or offer to sell. On Sunday, discussions with consumers need to be focused on educating consumers on vehicle features. The off-site permit for the auto show does NOT permit Sunday sales; off-site events are still subject to the Sunday closing law.

MEMORIAL FUND ESTABLISHED FOR CHAD JULIUS' FATHER

The Colorado Automobile Dealers Association Executive Committee recently voted
to establish a memorial fund to benefit the family of Michael Julius, father of CADA employee Chad Julius. Michael lost his battle with cancer in January.

The Michael Julius Memorial Fund was set up to help the family defray expenses related to his cancer treatments and funeral expenses.
