AUTOMOTIVE NEWS AT A GLANCE
Listed here are several articles pertaining to the
auto industry in general that appeared recently in newspapers and other media outlets across the nation.

NEW DAILY FEE ON CAR RENTALS: APPLIES TO WARRANTY WORK
In the June 24th issue of Open Road, New Daily Fee on Car Rentals Effective July 1st, we provided notice and information about a new, $2.00 daily fee on car rentals. The question has been asked whether this daily fee would apply when the dealer is being reimbursed by the manufacturer or other warranty provider. The answer from the state Department of Revenue is YES – the daily fee applies when there is a charge levied for the rental, and a payment being made, even if it is not the end-consumer.
The guidance issued by the state is that rentals are only exempt if they are “complimentary”. Visit the June 24th Open Road issue for more information and the state summary of this new fee.

GRASSROOTS ALERT! CALL TO ACTION!
By Melissa Kuipers, Vice President of Government Relations & Communications
CADA continues to aggressively seek co-sponsors for federal legislation, the Automobile Dealer Economic Rights Restoration Act. These bills, HR 2743 in the House and S. 1304 in the Senate, would ensure that the bankruptcies of Chrysler and GM do not eviscerate dealers’ rights under state franchise laws. The bill currently has 202 cosponsors in the House and 10 cosponsors in the Senate. Rep. Lamborn (R-CO), Rep. Perlmutter (D-CO) and Rep. Coffman (R-CO) have already signed on as cosponsors. Please contact the following members of the Colorado Congressional Delegation and encourage them to co-sponsor these critical pieces of dealer legislation.
HR 2743
Rep. Diana DeGette: 202-225-4431
Rep. Betsy Markey: 202-225-4676
Rep. Jared Polis: 202-225-2161

HOW IS THE RECESSION CHANGING HISPANICS AS CONSUMERS?
Entravision Guest Article
How is the economy affecting the Hispanic market? The answer, at this time, may be inconclusive. In a recent article by Terry Soto, president & CEO of About Marketing Solutions, she cites data from Experian and concludes that Hispanics may be "recession proof" or at least "recession aloof."

CONTROLLER SEMINAR: TECHNOLOGY COST CONTRO L AND COLORADO TAX AUDIT RISKS
Wed., July. 15th, 2009
7:30 am to 11:00am
Breakfast included
Paul Gillrie, national consultant and “the authority” on dealer technology and cost reduction will provide proven ways to reduce DMS/technology expenses—short-term and long-term
Bruce Nelson, CPA will highlight lessons learned from recent tax audits of Colorado dealers; with recent budget shortfalls, state/city audits are more frequent and much more aggressive
Part I: DMS Systems–Reducing monthly Costs/Billing Analysis, Negotiations, and the DMS Market Overall, by Paul Gillrie, The Paul Gillrie Institute (PGI), www.paulgillrie.com (1.5 hrs).
- How to reduce monthly computer expenses and identify unnecessary costs or over-billing
- Dealerships typically face a computer acquisition or upgrade every three to five years
DMS provider communications or upgrade terms (seemingly insignificant) may be amending your overall contract in key ways
Part II: Colorado Sales and Use Tax Audit Risk Areas -- (1.5 hours), by Bruce M. Nelson, Ehrhardt Keefe Steiner & Hottman PC (EKS&H)
- Review of lessons learned from recent dealership tax audits, advice for dealerships on areas of risk in state/local tax audits as well as other sources of potential liability.
Part III: HB1230 – New Colorado “Hold Harmless” Affidavit (1/2 hr), CADA Staff
- Review of new legislation providing some protection on sales/use taxes; dealers often hit in later tax audits to verify that the consumer provided the “correct” address for registration/titling
