Listed here are several articles pertaining to the
auto industry in general that appeared recently in newspapers and other media outlets across the nation.


CASH FOR CLUNKERS: COLORADO SALES / USE TAX

The Colorado Department of Revenue has issued a memo to address the application of sales/use taxes to the federal rebates available under the CARS / “Cash for Clunkers” program.  In summary:

  • The federal rebate is taxable – essentially this is treated like a manufacturer rebate, and does not reduce the purchase price for calculating sales/use taxes in Colorado
  • Additional trade-in allowance given to the scrap value of the car is not taxable, and is considered just like other trade-ins

REMINDER:  Please keep in mind that while the program dates are July 1st through November 1, 2009, the National Highway Traffic Safety Administration (NHTSA) still needs to finalize detailed rules and create an online system to implement this program. 
Because key aspects of the implementation are not yet final, CADA does not recommend that dealers provide customers with credits based on an expectation of being reimbursed through a yet-to-be-defined process.  For dealerships that choose to take the risk and provide rebates on deals that could ultimately not qualify, ensure you review all details possible of the parameters defined by the laws governing the program.  One of those is that the dealer must “give the credit to the consumer at the time of such transaction.”

GRASSROOTS ALERT!  CALL TO ACTION!

Just hours ago, a team of CADA dealers and staff returned from a highly successful trip to Washington DC.  CADA joined over 200 dealers from across America to lobby Congress to support HR 2743 and S. 1304.  These bills, commonly referred to as the Automobile Dealer Economic Rights Restoration Act, would ensure that the bankruptcies of Chrysler and GM do not eviscerate dealers’ rights under state franchise laws and would reinstate the terminated dealers across the country.  Keep in mind that these bills wound not unravel the bankruptcies of Chrysler and GM.  Instead, they would immediately reinstate all of the terminated franchised dealers that were terminated in bankruptcy. Once reinstated, the automakers could still choose to terminate dealers, but they would have to honor state franchise laws by providing compensation and termination assistance.

Colorado’s Congressional delegation has listened to our dealers and we are very excited and appreciative of their support.  As of the drafting of this article, six of the seven members of Colorado’s House of Representatives delegation are co-sponsors of HR 2743.  They are: Rep. Perlmutter, Rep. Coffman, Rep. Lamborn, Rep. Markey, Rep. Salazar and Rep. DeGette.  Senator Mark Udall has also co-sponsored S. 1304.

On July 21st and 22nd, the Judiciary Committee of the US House of Representatives, Subcommittee on Commercial and Administrative Law, will hold hearings on the “Ramifications of the Auto Industry Bankruptcies.”  CADA will be present for these hearings.  Rep. Maffei (D-NY), the prime sponsor of HR 2743, serves on this committee.  

Additionally, I will be traveling to Atlanta tomorrow for the annual American Legislative Exchange Council (ALEC) conference and to Philadelphia directly thereafter for the annual National Conference of State Legislatures (NCSL) conference.  Several Colorado legislators will be attending these events, including Colorado’s Speaker of the House Terrance Carroll.  I have a dinner meeting planned with the Speaker in Philadelphia to discuss the state of the industry and our legislative efforts.  I also have a second meeting with the Speaker where we will be joined for lunch by Damon Lester, the President of the National Association of Minority Automobile Dealers.  Mr. Lester has agreed to travel from Washington DC to Philadelphia to attend this meeting.
