CASH FOR CLUNKERS - COLORADO TAX UPDATES CLICK HERE for the latest information on how to apply Colorado sales/use taxes to CARS transactions. * * * * * * * * CASH FOR CLUNKERS - LATEST UPDATES As expected, NHTSA released final rules last Friday, July 24th on the implementation of the CARS program, aka “Cash for clunkers”. NADA held a webinar on Monday of this week, presented by NHTSA staff. At the end of that session, there were over 2,600 submitted questions! Needless to say there are many unanswered questions. NADA is working on the key questions and is expected to provide a more in-depth set of Questions and Answers as soon as possible. CONSUMERS CAN COMBINE FEDERAL AND STATE VEHICLE INCENTIVE PROGRAMS FOR A POSSIBLE $10,500 CREDIT! In addition to using the Cash for Clunkers program at the Federal level, CADA was influential in passing HB 1331 in the Colorado Legislature during the 2009 Session. This bill expands a 1999 law regarding motor vehicle tax incentives to now provide credits for compressed natural gas (CNG) cars and CNG conversions. There are also incentives for high efficiency hybrids and plug-in hybrid electric vehicles now qualify for the credit. All credits are capped at $6,000 per vehicle, except for the plug-in hybrid conversion. A qualifying hybrid vehicle can receive a credit related to both the vehicle purchase and conversion to a plug-in hybrid electric vehicle. The total amount of any Federal tax credits or other incentives combined with the state tax credit cannot exceed the consumer’s actual cost of the conversion or the difference between the actual cost and the cost of a similar traditional fueled vehicle. SUPPORT FOR HR 2743 AND S. 1304 CONTINUES TO GROW ON CAPITOL HILL Support for HR 2743 and S. 1304 continues to grow on Capitol Hill. HR 2743 currently has 263 co-sponsors, which is more than enough votes to secure passage out of the House of Representatives. S. 1304 now has 31 co-sponsors. All seven of Colorado’s House delegation are signed on as co-sponsors to HR 2743. In the Senate, Sen. Mark Udall is a co-sponsor of S. 1304. Sen. Michael Bennet, however, is not.
Last week, CADA attended the annual meeting of the National Conference of State Legislatures (NCSL) in Philadelphia, PA. Several Colorado legislators were present, including House Speaker Terrance Carroll (D-Denver) and Senate President Brandon Shaffer (D-Longmont). This trip was an excellent opportunity for Speaker Carroll and President Shaffer to hear about what has been happening in the automotive industry and fully understand the ramifications of the terminated dealerships in Colorado. Both have been incredibly supportive of dealer issues, including SB 91, the CADA bill to make improvements to the motor vehicle franchise statutes that passed during the 2009 session. In between legislative meetings in Philadelphia, we traveled to Washington DC to attend the House Judiciary Hearings on the ramifications of dealer closures. We were present when Ron Bloom, head of the White House Auto Task Force, testified before the committee and responded to questions from the committee. Mr. Bloom indicated that the White House was open to a non-legislative solution to the GM and Chrysler dealers that were terminated during bankruptcy. Clearly this statement would have never been made without the ever-growing Congressional support of HR 2743 and S. 1304. We will keep you posted on these potential non-legislative solutions from the automakers if and when they are offered. Finally, CADA is scheduling meetings with several Colorado legislators in anticipation of the 2010 Session. STEVE NILSSON EARNS HIS MASTER'S DEGREE IN DEALERSHIP MANAGEMENT Steve Nilsson, Glenwood Springs Ford LM, has earned his Master’s degree in Dealership Management in a new program supported by NADA at Babson College. Steve is the first and only Colorado dealer to gain the degree and was part of the first class in the newly developed program. DON HICKS IS ELECTED TO THE NADA BOARD OF DIRECTORS Don Hicks, Shortline Auto, has received word that he has been elected to the NADA Board of Directors in an at-large minority dealer position. Don was part of a close vote election, yet he prevailed and will go on the NADA Board of Directors. Jeff Carlson will continue in the NADA Director role representing Colorado, Essentially, we will have two active members who serve on the NADA at the same time.
