NADA ECONOMIC IMPACT REPORT FOR AUGUST, 2008

Next week August new light vehicle sales will
reflect a month when gasoline prices fell and
incentives lowered the effective prices for many
customers in the last 10 days of the month. Lower
fuel prices and lower effective vehicle prices
should help September sales results, but the assist
to the August sales results will be modest.

2009 NADA CONVENTION ACCOMODATIONS

As you begin receiving your registration materials for the 2009 NADA Convention in New Orleans, we would like to encourage you to consider a few of the properties the CADA events management team scouted on a recent trip to New Orleans.

EMPLOYERS BEWARE! FOUR ANTI-BUSINESS INITIATIVES ARE ON THE COLORADO BALLOT. YOUR BUSINESS IS THREATENED!! WHAT CAN YOU DO?

Attend a free briefing session to learn what you can do about the ballot initiatives that threaten Colorado's economy.
 
We hope we have your attention!! This year's election is critical to Colorado employers. Our state faces four anti-business, union-sponsored ballot initiatives that will create unprecedented negative changes in the laws governing the Colorado workplace:

  • Just cause for suspension or discharge of employees 
  • Additional employee lawsuits for workplace injuries
  • Mandatory healthcare coverage paid for by employers
  • Criminal liability for executive officials

Employers must take immediate action because absentee ballots go out in early October and votes will be cast soon. The Council is offering a free briefing session to support employers who oppose these initiatives. This session will:

  • Educate employers on the content of the initiatives and applicable election law. 
  • Help employers effectively communicate the reality of these initiatives with their employees.

Where and When: MSEC's Denver office on Monday, September 15 and at MSEC's Colorado Springs office on Tuesday, September 23. A session will be scheduled in Northern Colorado soon. The sessions will run from 9:00 am to 12:00 noon. Seating for these seminars will be limited so register today to reserve your place.

RECENT DEALERSHIP FINE FOR HAZARDOUS MATERIAL SHIPPING VIOLATION

One of the top categories of dealership violations in the area of environmental and safety compliance is related to federal hazardous materials transportation law.  Various substances that are defined as “hazardous” must be labeled properly, and anyone handling must be trained properly.  A dealership in Louisiana has been targeted with a proposed fine over $20,000 because they improperly shipped an eight ounce can of Ford Motorcraft Interior Spray Paint via UPS. 

5. At all times mentioned herein, the above-described package was not marked with the proper shipping name or UN identification number of the hazardous material, was not labeled with the proper hazardous materials labels, was not accompanied by a shipper's declaration of dangerous goods, shipper's certification or other proper shipping documents

Class action wage and hour lawsuits are now as common

as discrimination lawsuits

Objective:

To provide an analytical framework and working knowledge of the Fair Labor Standards Act (FLSA). Class action wage and hour lawsuits are now as common as discrimination lawsuits. Despite the 2004 revisions to the Fair Labor Standards Act, wage and hour problems continue to perplex employers in every industry. Participants will learn common pitfalls to avoid such as failing to pay overtime to salaried employees who are not exempt or allowing employees to use comp time outside the week when overtime is worked. Most who attend this seminar return to their organization and change one or more pay practices.

Highlights of topics include:

  • Coverage and industry exemptions
  • Recordkeeping and retention requirements
  • Exemptions from overtime: executive, administrative, professional, computer / outside sales
  • Calculating overtime for commissioned employees (salespersons), salaried non-exempts, etc.
  • Changing status for employees who have been improperly classified as exempts
  • Compensable hours of work - travel time, training, preliminary activities
  • Compensation included in overtime calculations - bonus payments, shift differentials, etc.

BOB PENKHUS RECEIVES A 35-YEAR AWARD FOR MAZDA

Bob Penkhus, right, of Bob Penkhus Mazda in Colorado Springs, Colo., receives an award celebrating 35-years as a Mazda dealer from David Klan, Mazda North American Operations' Western regional general manager.   Mr. Penkhus has two family owned Mazda dealerships in Colorado: Bob Penkhus Volvo Mazda at Motor City and Bob Penkhus Mazda at Powers Auto Park. 

In 2007 Bob Penkhus celebrated 50 years with Volvo.  Bob Penkhus Volvo Mazda at Motor City is one of the 10 oldest Volvo dealerships in the nation.
