2009 NADA CONVENTION ACCOMMODATIONS

As you begin receiving your registration materials for the 2009 NADA Convention in New Orleans, we would like to encourage you to consider a few of the properties the CADA events management team scouted on a recent trip to New Orleans.

EMPLOYERS BEWARE! FOUR ANTI-BUSINESS INITIATIVES ARE ON THE COLORADO BALLOT. YOUR BUSINESS IS THREATENED!! WHAT CAN YOU DO?

Attend a free briefing session to learn what you can do about the ballot initiatives that threaten Colorado's economy.
 
We hope we have your attention!! This year's election is critical to Colorado employers. Our state faces four anti-business, union-sponsored ballot initiatives that will create unprecedented negative changes in the laws governing the Colorado workplace:

  • Just cause for suspension or discharge of employees 
  • Additional employee lawsuits for workplace injuries
  • Mandatory healthcare coverage paid for by employers
  • Criminal liability for executive officials

Employers must take immediate action because absentee ballots go out in early October and votes will be cast soon. The Council is offering a free briefing session to support employers who oppose these initiatives. This session will:

  • Educate employers on the content of the initiatives and applicable election law. 
  • Help employers effectively communicate the reality of these initiatives with their employees.

Where and When: MSEC's Denver office on Monday, September 15 and at MSEC's Colorado Springs office on Tuesday, September 23. A session will be scheduled in Northern Colorado soon. The sessions will run from 9:00 am to 12:00 noon. Seating for these seminars will be limited so register today to reserve your place.

RELIGIOUS DISCRIMINATION: JUST HOW DIFFERENT IS IT?

DAMAGE DISCLOSURE REMINDER

This is to remind you of the following applicable statutes and regulations that cover the issue of prior damage disclosure.  It has come to our attention that some manufacturers may be offering/providing large quantities of new cars that sustained some prior hail damage to their dealers (specifically Audi and Subaru have been mentioned recently).  We also frequently receive calls about damage disclosure requirements. 

While some states do have specific monetary damage limits above which any prior damage to a car must be disclosed to the consumer, Colorado does not.  Generally in Colorado, the governing statutes and regulations require disclosure of damage that is “MATERIAL.”  This is a vague term, and because ‘material’ generally is interpreted in light of each, particular customer, CADA’s business advice is to disclose ALL prior damage of which the dealership has knowledge. Some attorneys have also suggested taking photograph(s) of the damage and keeping a copy of the photo in the deal jacket.

Class action wage and hour lawsuits are now as common
as discrimination lawsuits

Objective:

To provide an analytical framework and working knowledge of the Fair Labor Standards Act (FLSA). Class action wage and hour lawsuits are now as common as discrimination lawsuits. Despite the 2004 revisions to the Fair Labor Standards Act, wage and hour problems continue to perplex employers in every industry. Participants will learn common pitfalls to avoid such as failing to pay overtime to salaried employees who are not exempt or allowing employees to use comp time outside the week when overtime is worked. Most who attend this seminar return to their organization and change one or more pay practices.

Highlights of topics include:

  • Coverage and industry exemptions
  • Recordkeeping and retention requirements
  • Exemptions from overtime: executive, administrative, professional, computer / outside sales
  • Calculating overtime for commissioned employees (salespersons), salaried non-exempts, etc.

50-YEAR DEALER AWARD FOR McCADDON CADILLAC

The attached photo is a 50 year dealer award for McCaddon Cadillac.  The dealership name currently is McCaddon Cadillac, Buick, Pontiac-GMC, in Boulder, CO.

The McCaddon Dealership was founded by George McCaddon in November of 1958.  They have been family owned and operated since that time.  Son Mark now operates the dealership and hopes to continue for many more years to come.  McCaddon was originally started as a Cadillac and Oldsmobile franchise, and then later acquired the Buick and GMC lines in 1990, and finally the Pontiac franchise in 2005.  

McCaddon would like to thank all (mostly our loyal customers) who have made the last 50 years possible.
