AUTOMOTIVE NEWS AT A GLANCE

Listed here are several articles pertaining to the
auto industry in general that appeared recently in newspapers and other media outlets across the nation.

  • Bailout OK'd, but markets remain sickly
    Rocky Mountain News, October 3
Like a patient who has just swallowed some bitter medicine, markets will have to wait awhile longer before their ills go away.
  • Executives pledge funds as unions drop colorado initiatives
The Wall Street Journal, October 3
In an alliance born in part of fear, corporate executives across Colorado pledged to contribute at least $3 million to help organized labor defeat ballot measures that many in the business community might normally support.
  • Business, labor ballot deal a lemon
Steamboat Pilot & Today, Ocotober 5
Shrewd in making deals in their own respective realms, the power brokers who agreed to pay labor union bosses $3 million in exchange for withdrawing four job-killing ballot initiatives have been played for suckers.
  • Gas prices fall 46 cents in week
    The Detroit News, September 29
Motorists filling up their tanks are finding it less painful at the pump: Gas prices fell 46 cents in the last week -- one of the biggest weekly price drops in state history, according to AAA Michigan.

  • Soft economy drags on car sale
    The Detroit News, September 29
Auto sales are expected to continue a prolonged slide when September results are reported this week as the ongoing financial crisis heaps more bad news on an industry coping with weak consumer confidence, forecasters and analysts said.

NADA NEWS

  • Jobs posted on NADA’s job board, Automotive Careers Online, have accrued nearly 10,000 views and as many as 250 views for a single job posting since the site was launched in March. “That’s a solid return on investment for employers registered for the site,” says John Lyboldt, NADA vice president of dealer operations. “More than 500 job seekers have registered for the site and many have applied for dealership jobs.” Automotive Careers Online is a dedicated job board exclusively for NADA members to post openings. Job posting packages start at $200 for a 30-day listing, which is a fraction of the cost of other commercial job boards and classified ads. Employers set the skills criteria for openings. E-mail alerts notify an employer of matching candidates once a resume is posted. The site is free for job candidates, who can post resumes and search for dealership careers. To sign up, visit www.AutomotiveCareersOnline.com.

REMINDER: NEW FEDERAL RED FLAGS & ADDRESS DISCREPANCY RULES: COMPLIANCE DEADLINE IS NOVEMBER 1st

A reminder that the mandatory compliance deadline for the new, federal Red Flags rule is now one month away—November 1st, 2008.  All dealerships should be taking the necessary steps to implement a program.

ALERT - LAST CHANCE!  NADA has added an additional webinar on October 20th for those who still need training or an opportunity to ask questions about implementing the new rules.  See the training calendar below for more details.

CLICK HERE to review the article from last week’s Open Road, Legal & Regulatory section.

*Helpful tip:
Did you know that (generally) the first three digits of a person’s social security number are based upon where the person resided when the application for a social security number was made?

Visit www.socialsecurity.gov/employer/stateweb.htm for more details.  This information can help confirm the validity of a social security number, especially after one or more ‘red flags’ have been detected.

TWO NEW NADA LEGAL COMPLIANCE PUBLICATIONS NOW AVAILABLE ONLINE

NADA has finalized two new publications aimed at helping dealers comply with several new federal legal requirements. All members will receive a free printed copy of A Dealer Guide to the FTC Affiliate Marketing Rule (L51) and Electronic Disclosure Rules for Dealership Online Commerce (L52) via mail.
NADA Management Education is also making these two publications available immediately, in PDF form, free to members upon request.

The FTC’s Affiliate Marketing Rule specifies when certain credit-related information received from a company’s affiliates may be used for marketing purposes. The guide covering this new rule defines key terms, explains the new rule’s relationship to existing information-sharing restrictions under the Fair Credit Reporting Act, and provides examples of the notices required under the new rule.

The Federal Reserve Board’s Electronic Disclosure Rules affect dealers who currently engage in certain online activities (such as advertising leases online, advertising credit online, or providing access to/accepting online credit applications), or envision doing so in the future. This publication explains the rules, discusses amendments to certain regulations—including Regulations B, M, and Z—and provides context and compliance considerations.

  1. Members may obtain a free PDF copy of each publication by sending an email to me@nada.org  with their requests and member identification numbers.

All NADA Publications are available at the following:
www.nada.org/Publications/

DISCLAIMER: CADA is not authorized to dispense legal advice.
The information contained in this weekly email is intended to provide important updates and reminders regarding statutes, litigation, and regulations. CADA always advises that dealers should consult legal counsel on the specifics of any laws or regulations to ensure proper compliance.
