AUTOMOTIVE NEWS AT A GLANCE
Listed here are several articles pertaining to the
auto industry in general that appeared recently in newspapers and other media outlets across the nation.

CARS / CASH FOR CLUNKERS - TITLE BRANDING FOR THE CLUNKER TRADE INS - CORRECTION
In last week’s Open Road e-newsletter, we ran an article that the Dept. of Revenue requested to receive copies of the junked titles from dealers in order to update the state titling system. Upon further clarification of this, since the original titles of the junked cars would have been assigned to the recyclers/salvage companies, any obligation to update the state would be with them. Further, as noted on the Disposal Facility Certification Form there is an affirmation that the recycler/crusher will report to the NMVTIS (National Motor Vehicle Title Info System).
***Dealers do not need to provide copies of the junked car titles to Department of Revenue ***

DEALER ADVERTISING -- REMINDERS
Dealerships are reminded to review and ensure that all staff or outside vendors writing advertisements on behalf of the dealership are aware of state laws and regulations regarding motor vehicle advertising:
There is a general statutory obligation to ensure advertising is not “misleading” and does not “misrepresent”:
C.R.S. 12-6-118(3)(k). To intentionally publish or circulate any advertising which is misleading or inaccurate in any material particular or which misrepresents any of the products sold or furnished by a licensed dealer.
The state motor vehicle dealer board also has regulations with more clarification of what is considered ‘misleading’ in some specific circumstances (this list is by no means exhaustive); CLICK HERE for a copy of those regulations.
In addition, the prior Open Road articles below contain additional information:
March 26, 2008 INTERNET ADVERTISED PRICE MUST MATCH PRINT ADS
March 19, 2008 ADVERTISEMENTS MUST INCLUDE DEALERSHIP NAME
January 10, 2007 AUTO INDUSTRY DIVISION ALERT REGARDING INTERNET

CADA always advises that dealers should consult legal counsel on the specifics of any laws or regulations to ensure proper compliance

LEGISLATIVE POLICY COMMITTEE LEADERS PASS THE TORCH
After two years of tremendous success under their leadership of CADA’s Legislative Policy Committee (LPC), Matt Tynan and Don Hicks transitioned out of their positions at an appreciation dinner held by CADA at Root Down last Thursday night. Joined by their spouses, multiple dealers and CADA staff, Matt and Don graciously spoke about their work and accomplishments. Matt and Don were honored with beautiful awards hand-carved in the symbol of victory to commemorate their commitment and success. As of last week’s dinner, Ben Faricy and Todd Bondy will take over as the co-chairs of the LPC. We are excited for their leadership as we prepare for the 2010 Legislative Session. A big THANK YOU goes out to to Matt Tynan and Don Hicks for your commitment, meaningful contributions, and amazing dedication to CADA over the last 2 years.

BE A PART OF CADA'S GRASSROOTS EFFORTS!
In large part, CADA’s legislative success is due to the active and meaningful participation of our member dealers in grassroots activism. We are in the process of scheduling 30 meetings across Colorado between now and when the General Assembly convenes for the 2010 Session on January 13th. To see a current list of the meetings we have confirmed, please click here and RSVP to Lauren Stadler at lauren.stadler@coloradodealers.org if you plan to attend. We can’t wait to see you at these very important and educational meetings!

Presented by William E. Walters, Kelly Garnsey Hubbell + Lass, LLC

- Re-cap of existing protections, and manufacturer relations generally
- Lessons learned in GM/Chrysler bankruptcies
- Dealer Obligations: keep your dealership out of the cross-hairs of regulators, lawyers, and consumers!
