NADA 2009 CONVENTION AND EXPOSITION
New Orleans is now the eighth fastest growing metropolitan area in the United States, according to the U.S. Census Bureau. To show support for the rebirth of New Orleans, NADA is headed back to the Big Easy to hold its 92nd annual convention and exposition there Jan. 24-27, 2009.
“The theme for our New Orleans convention is 'Voice of the Dealer® ... Committed to Community.' What better way to show that commitment than for us to be there in full strength at one of NADA's favorite convention cities," said Annette Sykora, 2008 NADA Chairman. NADA has held its convention in New Orleans every few years for the past 30 years.

Hundreds of thousands of new cars and trucks that would have quickly made their way to people's driveways a year ago are stacking up on dealer lots across the country.
- Ford considering Mazda sale
The Detroit News, October 11
Ford Motor Co. is weighing a possible sale of part of its stake in Mazda Motor Corp., but sources familiar with the situation stressed that no deal has been reached.
- GM, Chrysler talk merger
The Detroit News, October 11
General Motors Corp. is in talks with Cerberus Capital Management LP about a possible merger with Chrysler LLC, a person familiar with the matter said late Friday.

NADA NEWS
- NADA’s immediate customer follow-up and complaint-resolution program, NADA-24, recently completed its five-millionth interview. Launched in 2005, the program provides feedback to dealers the day after a customer buys or services a vehicle, enabling quick responses to customer problems and helping to build loyalty. Customers are contacted and asked three questions to gauge their level of satisfaction. Visit www.nada-24.com for more.

REMINDER: NEW FEDERAL RED FLAGS & ADDRESS DISCREPANCY RULES: COMPLIANCE DEADLINE IS NOVEMBER 1st
A reminder that the mandatory compliance deadline for the new, federal Red Flags rule is now one month away—November 1st, 2008. All dealerships should be taking the necessary steps to implement a program.

Attention owners/principals: please be aware there is a provision in the new Red Flags rule that the Identity Theft Prevention Program (ITPP) be approved by your board of directors, or a designated senior management employee by November 1st.

CUSTOMER CREDIT INFORMATION ACCEPTED OVER THE INTERNET MUST BE SECURE
Dealers are reminded that customer information submitted by online credit applications must be transmitted securely/encrypted. Email is generally not secure.
FTC Safeguards Rule requires that dealerships
protect not only customer information that is physically maintained within
the dealership, but also customer
information that dealers “access, collect, distribute, process, protect,
store, use, transmit, dispose of, or otherwise handle…”
It is recommended that
dealers consult NADA’s publication, L43 “A Dealer Guide to Safeguarding Customer Information”,
for guidance in each of these areas, including the following:
“[With regard to]
the transmission of customer credit applications over the Internet, you
should ensure that the program application you use encrypts the data or
otherwise transmits it in a secure manner to the bank or finance
company. If you are submitting the customer’s application over the
Internet, you should ensure that the information displayed on your
computer screen is not visible to others who are not authorized to have
access to this information.”
Dealers are also
encouraged to review the FTC’s latest publication entitled, “Financial

Colorado Automobile Dealers Association Members Profit Through Risk Management 
The Designated Risk Manager Training Program was developed to target specific risk management concerns for the auto dealer industry. Companies that are the most successful controlling losses have designated a key person as their risk manager. This person is supported by top management and is both responsible and accountable for identifying loss exposures and implementing risk management solutions.
Through CADA’s partnership with Federated Insurance, there is no charge to attend this training and you do not have to be a current Federated client. Attendees, however, are responsible for air and ground transportation to and from Owatonna, Minnesota, and lodging in Owatonna.
